SOCIAL MEDIA TERMS & CONDITIONS

 

Thank you for joining STRAND NEIGHBOURHOOD WATCH which allows you to be added either the Patrollers or Observers WhatsApp groups.

 

The aim of these groups is:

  • Get to know your neighbours and to look out for one another.
  • Share all things relevant to the safety of the community.
  • Share relevant crime information with the community.

These groups are an extensions of STRAND NEIGHBOURHOOD WATCH’s communication channels and as such, are also governed by the STRAND NEIGHBOURHOOD WATCH constitution and the mandate under which we work in conjunction with the relevant law enforcement departments. They are only open to signed-up STRAND NEIGHBOURHOOD WATCH members that agree to adhere to these Rules and Regulations. Crime related information is sensitive as it can impact on the apprehension on the criminal/s and their prosecution. Please read through the list below so that you have an idea of what can and cannot be said, shared and broadcast on these groups. Failure to adhere to these guidelines may result in your removal from these groups depending on the infringement. This decision will be taken by the STRAND NEIGHBOURHOOD WATCH Management Committee and will be final.

 

  1. Content shared on these groups is for STRAND NEIGHBOURHOOD WATCH members ONLY. Content from these groups may NOT be shared with any third party unless otherwise specified. Only Management may forward the information on the other groups.
  2. NO posts of crime scenes and number plates that can cause complication with SAPS investigation are permitted.
  3. Refrain from replying with “copy” on posts sent as this have negative results on others users.
  4. These groups are NOT chat groups. They are in place to report suspicious behaviour / concerns / crime related information and information relevant to our area.
  5. We reserve the right to promote and share other activities and events in our area that have positive impact on crime and grime. This includes community building events, as a strong community is the best deterrent for crime.
  6. Please message management members privately if you are asked to do so for feedback or if you have any concerns or suggestions.
  7. We consider ourselves a community organisation and our aim is to uplift our area and support each other. Only constructive criticisms is allowed. A respectful question, to clarify a situation or a friendly, constructive suggestion goes a long way. A debate on various viewpoints should be taken up offline.
  8. Over many years we have built and strengthened our relationship with SAPS and our security service providers. We are extremely happy to have some of members on our groups. If you would like to take up matters with SAPS, please do so through management or directly with SAPS.
  9. NO jokes, religious comments, hate speech, racism, politics, and vulgar language or off topic posts are allowed on these groups.
  10. Absolutely no advertising will be permitted on these groups. This includes, but is not limited to products, services, security, other Neighbourhood Watches and NPOs.
  11. Management reserve the right to remove members who won’t adhere to Admins’ instructions.

These WhatsApp groups DO NOT replace our 24 hour Emergency Control room, SAPS or your armed response company as it is not an emergency channel. We would like to advise that our 24 hour Emergency Control room, SAPS or your armed response company be your FIRST point of call should a serious incident occur. These WhatsApp groups do not replace our radio network which is a far more effective and successful form of communication.

 

 

INDEMNITY

 

  1. I hereby acknowledge that I have read the Code of Conduct as extracted from the Constitution of the STRAND NEIGHBOURHOOD WATCH, and fully understand the terms thereof;
  2. Acknowledge that I have chosen to be a member of STRAND NEIGHBOURHOOD WATCH and voluntarily participate in patrolling activities.
  3. Acknowledge further that the STRAND NEIGHBOURHOOD WATCH is not a corporate entity established by or under any law nor does it have juristic personality.
  4. Indemnify the aforesaid STRAND NEIGHBOURHOOD WATCH, its committee and other members, in respect of any criminal or civil liability, against any costs, claims, suits or damages howsoever arising directly or indirectly from any intentional act or omission or any negligence on my part.

STRAND NEIGHBOURHOOD WATCH CODE OF CONDUCT

 

  1. This Code of Conduct of STRAND NEIGHBOURHOOD WATCH shall be binding on all members of STRAND NEIGHBOURHOOD WATCH.
  2. Members of STRAND NEIGHBOURHOOD WATCH must at all times act in a non-violent manner. No member may take the law into his or her own hands irrespective of circumstances.
  3. No member of STRAND NEIGHBOURHOOD WATCH shall display racism, sexism or any other form of discrimination towards any member and any other person.
  4. When on patrol a STRAND NEIGHBOURHOOD WATCH member may only use ‘minimal force’, as described in the Criminal Procedure Act No 51 of 1977 to secure the arrest of the perpetrator of an offence and no intimidation in whatever form may be used in the communities where such patrols will be taking place.
  5. No member of STRAND NEIGHBOURHOOD WATCH may when patrolling, carry any weapon(s) perceived to be dangerous that could inflict serious bodily harm and/or damage property. Only weapons of sole purpose of self-defence as approved by the Provincial Commissioner South African Police Services – Western Cape may be used.

POPI ACT

 

SNW and the member of the SNW (herein after referred to as “the Parties”) acknowledges their respective obligations to comply with the substantive provisions of the Protection Personal Information Act, 4 of 2013 (herein after referred to as POPI). Where any party receives any personal information as defined in POPI it shall ensure that it fully complies with the provisions of the Act and only deal with the personal information to fulfil its obligations under the Application for membership with SNW. The personal information received shall not be further processed or disclosed without the consent of the disclosing party.

 

Each party further understands that violation of the provisions dealing with POPI may subject that party to applicable legal penalties, including those provided under POPI.

 

Within thirty (30) days after the termination of this Agreement, for whatever reason, the receiving party of either party’s personal information shall return same or at the discretion of the disclosing party of such personal information, destroy such personal information, and shall not retain copies, samples or excerpts thereof. In cases where the disclosing party has elected for the personal information to be destroyed, as provided for in above clause, the receiving party shall, within ten (10) days of receiving the instruction to destroy the personal information, send an affidavit confirming the destruction of personal information.
